Can a minibus use a bus lane?

On March 15 2021, Prime Minister Boris Johnson announced that the UK government’s new bus strategy, backed by a £3million investment, will see the introduction of “hundreds of miles of new bus lanes”. We at Marshall Minibus are keen to inform minibus drivers about the rules surrounding bus lanes and how they might apply to them.
What is a bus lane?
The Highway Code rule 141 says, “Bus lanes are shown by road markings and signs that indicate which (if any) other vehicles are permitted to use the bus lane.
"Unless otherwise indicated, you should not drive in a bus lane during its period of operation. You may enter a bus lane to stop, to load or unload where this is not prohibited.”
Who can drive in a bus lane?
This is dependent on the area and signage for each bus lane. A minibus with more than ten seats, including the driver’s seat, can drive in most bus lanes, unless the sign says ‘local’ – in which case the lane is reserved for local bus services. Other relevant symbols on the bus lane sign may indicate that licenced taxis, motorcycles, mopeds, scooters, tricycles or bikes may use the lane.
It is also worth noting that any vehicle can drive in a bus lane outside of its operating hours, which should be provided on the bus lane signage.
What are penalty charge notices?
If you drive an unauthorised vehicle in a bus lane during its operating hours, you may receive a penalty charge notice (PCN).
A penalty charge must be paid within 28 days and may be reduced if you pay within 14 days. Information about how to pay a penalty charge and further penalties for failing to pay a penalty charge can be found on the government website.
